Risk of poor production
The absence or non-compliance of a manufacturer's plate exposes the manufacturer to heavy and immediate penalties:
- Sale prohibited The machine may be blocked in customs (export) or prohibited from being marketed on the European market for lack of CE marking.
- Criminal liability : In the event of a personal injury accident, if the plate is missing, illegible or non-compliant (lack of traceability), the manufacturer is presumed guilty of "endangering others".
- Refusal to provide insurance : In the event of an accident (fire, machine breakdown), the operator's insurance may refuse to cover damage caused by a machine considered to be "ghost" (unidentified).
- Sale voided The buyer has the right to cancel the sale for "non-conformity" and demand a full refund if the legal identification is faulty.
